1. Acceptance of these terms
By creating an account, submitting a pre-approval request, or otherwise using any feature of the LeasingMortgage platform (the “Platform”), you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Platform.
2. Nature of the service
LeasingMortgage is an information and comparison platform. We help users compare leasing, mortgage, personal loan, business loan, and credit card products offered by third-party banks, leasing companies, and finance providers (each, a “Lender”) operating in Sri Lanka.
We are not a lender, broker, or financial adviser. We do not ourselves provide credit, leasing, or any financial product. Where you submit a pre-approval request or apply for a product, the contract for that product is formed directly between you and the Lender, on the Lender’s own terms, conditions, and pricing.
3. Eligibility
To use the Platform you must:
- be at least 18 years of age;
- be a resident of Sri Lanka or have a legitimate financial connection to Sri Lanka;
- have legal capacity to enter into a binding contract under Sri Lankan law; and
- provide accurate, current, and complete information when requested.
Lenders and corporate users must additionally be duly registered or licensed in Sri Lanka and authorise the individual creating the account to act on their behalf.
4. Account registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@leasingmortgage.lk of any unauthorised use. We may require email or mobile verification before certain features (such as pre-approval submission) are unlocked.
5. No financial advice
All product information, calculator outputs, eligibility estimates, and comparison rankings on the Platform are provided for general informational purposes only and do not constitute financial, tax, legal, or investment advice.
Calculator results are estimates based on the inputs you provide and the product information available to us at the time of calculation. Actual rates, fees, charges, eligibility, and terms are determined by the relevant Lender at the time of application and may differ from the figures shown on the Platform. Before making any financial decision, you should read the Lender’s product documentation in full and consider seeking independent advice.
6. User content and accuracy
You agree that the information and documents you submit to the Platform are true, accurate, and complete to the best of your knowledge. Submitting materially false information, including in a pre-approval request, may constitute an offence under Sri Lankan law and may result in suspension of your account and rejection of your application by the Lender.
By submitting content (including reviews, comments, or documents) you grant us a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content for the purpose of operating and improving the Platform.
7. Lender and third-party content
Product details, interest rates, fees, eligibility criteria, and promotional content are supplied by Lenders or sourced from publicly available materials. While we make reasonable efforts to keep this information current and accurate, we do not guarantee that it is free from errors or that it reflects the most recent offer from the Lender. The Lender’s own quotation, letter of offer, or facility agreement will prevail over anything shown on the Platform.
8. Promotions, draws, and rewards
We may from time to time run draws, campaigns, or reward schemes on the Platform. Each such promotion is subject to its own published terms, including eligibility, entry conditions, and prize details. In the event of conflict between these Terms and the published terms of a specific promotion, the promotion-specific terms will prevail in respect of that promotion.
9. Fees and payments
Use of the Platform by individual borrowers is generally free of charge. Where a feature is offered on a paid basis (for example, a premium provider listing), the applicable fees, taxes, and refund terms will be disclosed before you commit. All fees are stated in Sri Lankan Rupees (LKR) unless otherwise indicated and are inclusive of any taxes required to be charged under Sri Lankan law.
10. Intellectual property
The Platform, including its text, graphics, logos, calculator engines, and software, is owned by LeasingMortgage or our licensors and is protected by copyright, trademark, and other laws of Sri Lanka and applicable international treaties. You are granted a limited, non-exclusive, non-transferable licence to access and use the Platform for your personal, non-commercial use, subject to these Terms. Lender logos and product names are the property of the respective Lenders and are used with permission or under fair use principles for the purpose of identification and comparison.
11. Prohibited use
You must not, and must not attempt to:
- use the Platform in breach of any law of Sri Lanka, including the Computer Crimes Act, No. 24 of 2007;
- submit applications using another person’s identity, NIC, or documents without lawful authority;
- attempt to gain unauthorised access to the Platform, other accounts, or our underlying systems, or interfere with their operation;
- scrape, harvest, or systematically extract data from the Platform without our prior written consent;
- upload viruses, malware, or any code designed to disrupt or damage the Platform;
- use the Platform to harass, defame, or send unsolicited communications to other users or Lenders; or
- reverse engineer, decompile, or otherwise attempt to derive the source code of the Platform, except to the extent permitted by law.
12. Suspension and termination
We may suspend or terminate your access to all or part of the Platform, with or without notice, if we reasonably believe that you have breached these Terms, if continued access poses a security or legal risk, or if required by law. You may close your account at any time by contacting us. Sections that by their nature should survive termination (including sections 10, 13, 14, 15, and 16) will remain in force.
13. Disclaimer of warranties
To the maximum extent permitted by Sri Lankan law, the Platform is provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or free of harmful components.
14. Limitation of liability
To the maximum extent permitted by law, LeasingMortgage and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or exemplary loss, including loss of profit, business opportunity, goodwill, or data, arising from or in connection with your use of the Platform.
Without limiting the above, our aggregate liability to you arising out of or in connection with the Platform in any 12-month period will not exceed the greater of (a) the amounts paid by you to us during that period or (b) LKR 10,000.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under the laws of Sri Lanka, including liability for death or personal injury caused by negligence, or for fraud.
15. Indemnity
You agree to indemnify and hold harmless LeasingMortgage from and against any claims, damages, costs, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) information you submit to the Platform, or (c) your unlawful use of the Platform.
16. Governing law and jurisdiction
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) are governed by the laws of the Democratic Socialist Republic of Sri Lanka. You and we submit to the exclusive jurisdiction of the competent courts of Colombo, Sri Lanka, save that we may bring proceedings to enforce our intellectual property rights in any jurisdiction where infringement is occurring.
17. Changes to these terms
We may update these Terms from time to time. The “Last updated” date at the top of this page indicates when the most recent changes took effect. For material changes we will give reasonable advance notice (for example by email or an in-platform notice). Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
